En effet, s\u2019il s\u2019agit d\u2019une partie privative que le syndicat des\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>copropri\u00e9taires loue \u00e0 l\u2019un des copropri\u00e9taires pour y loger le gardien, le propri\u00e9taire r\u00e9cup\u00e8re\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>le local une fois la gardienne partie.\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\">\u00a0<\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><span style=\"font-family: TimesNewRomanPS-BoldMT;\"><span style=\"font-size: small;\"><span style=\"text-decoration: underline;\">A. Vote de la suppression du poste :<\/span><\/span><\/span><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>\u00a0<\/strong><\/span><strong><span style=\"font-family: TimesNewRomanPSMT;\">\u00a0<\/span><\/strong><\/div>\n<div>\u00a0<strong style=\"font-family: TimesNewRomanPSMT;\">\u00a01. <em>Le poste est pr\u00e9vu par le r\u00e8glement de copropri\u00e9t\u00e9<\/em> :<\/strong><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>en principe, la suppression doit \u00eatre vot\u00e9e\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>\u00e0 l\u2019unanimit\u00e9, cette suppression constituant une atteinte aux modalit\u00e9s de jouissance des\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>parties privatives r\u00e9sultant du r\u00e8glement. <\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>Cependant, on observe, en jurisprudence, une\u00a0<\/strong><\/span><span style=\"font-family: TimesNewRomanPSMT;\"><strong>tendance \u00e0 admettre que cette suppression est possible \u00e0 la double majorit\u00e9 de l\u2019article 26 de\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>la loi du 10 juillet 1965, s\u2019il peut \u00eatre mis en place des solutions de substitution apportant des\u00a0<\/strong><\/span><span style=\"font-family: TimesNewRomanPSMT;\"><strong>avantages \u00e9quivalents et \u00e9ventuellement plus \u00e9conomiques (CA Paris, 24 juin 1988, 12 f\u00e9vrier\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>1993).\u00a0<\/strong><\/span><\/div>\n<div><\/div>\n<div><a href=\"http:\/\/ecocopro.com\/wp-content\/uploads\/2011\/02\/velo3.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-10546 aligncenter\" alt=\"velo3\" src=\"http:\/\/ecocopro.com\/wp-content\/uploads\/2011\/02\/velo3.jpg\" width=\"276\" height=\"182\" \/><\/a><\/div>\n<div><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\">\u00a0<\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>2.<em>Le poste n\u2019est pas pr\u00e9vu par le r\u00e8glement de copropri\u00e9t\u00e9<\/em> :<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>\u00a0La suppression s\u2019appr\u00e9cie par\u00a0rapport \u00e0 la destination de l\u2019immeuble, notion appr\u00e9ci\u00e9e souverainement par les juges du fond.Si le service contribue au standing de l\u2019immeuble et affecte donc sa destination, la\u00a0suppression doit \u00eatre vot\u00e9e \u00e0 l\u2019unanimit\u00e9. En revanche, si la destination de l\u2019immeuble a\u00a0\u00e9volu\u00e9 et que l\u2019existence d\u2019un concierge ne se justifie plus, la double majorit\u00e9 de l\u2019article 26\u00a0suffit (CA Versailles, 25 mai 1992).\u00a0\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>\u00a0<\/strong><\/span><\/div>\n<div><strong><span style=\"font-family: TimesNewRomanPSMT;\"><span style=\"text-decoration: underline;\">B. Affectation en local de v\u00e9los:<\/span><\/span><\/strong><\/div>\n<div><strong><span style=\"font-family: TimesNewRomanPSMT;\">\u00a0<\/span><\/strong><span style=\"font-family: TimesNewRomanPSMT;\">\u00a0<\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPS-BoldMT;\">\u00a0<\/span><strong style=\"font-family: TimesNewRomanPSMT;\">Il s\u2019agit d\u2019une modification de la destination d\u2019un local commun afin de recevoir une\u00a0<\/strong><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>utilisation mieux adapt\u00e9e aux besoins de la collectivit\u00e9. L\u2019article 30 de la loi du 10 juillet\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>1965 pr\u00e9voit un vote \u00e0 la double majorit\u00e9 de l\u2019article 26.\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>L\u2019assembl\u00e9e g\u00e9n\u00e9rale fixe, \u00e0 la m\u00eame majorit\u00e9, la r\u00e9partition du co\u00fbt d\u2019\u00e9ventuels travaux\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>d\u2019am\u00e9nagement, mais \u00e9galement la r\u00e9partition des d\u00e9penses de fonctionnement et d\u2019entretien.\u00a0<\/strong><\/span><\/div>\n<div><\/div>\n<div><\/div>\n<div><a href=\"http:\/\/ecocopro.com\/wp-content\/uploads\/2011\/02\/velo.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"size-medium wp-image-10544 aligncenter\" alt=\"velo\" style=\"font-family: TimesNewRomanPSMT;\"><strong>\u00a0<\/strong><\/span><strong><span style=\"font-family: TimesNewRomanPSMT;\">\u00a0<\/span><\/strong><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><em><span style=\"font-family: TimesNewRomanPS-ItalicMT;\"><strong>\u00ab L\u2019assembl\u00e9e g\u00e9n\u00e9rale des copropri\u00e9taires, statuant \u00e0 la double majorit\u00e9 pr\u00e9vue \u00e0 l\u2019article\u00a0<\/strong><\/span><\/em><\/span><\/div>\n<div><em><span style=\"font-family: TimesNewRomanPS-ItalicMT;\"><strong>26 peut, \u00e0 condition qu\u2019elle soit conforme \u00e0 la destination de l\u2019immeuble, d\u00e9cider toute\u00a0<\/strong><\/span><\/em><\/div>\n<div><em><span style=\"font-family: TimesNewRomanPS-ItalicMT;\"><strong>am\u00e9lioration, telle que la transformation d\u2019un ou de plusieurs \u00e9l\u00e9ments d\u2019\u00e9quipement\u00a0<\/strong><\/span><\/em><\/div>\n<div><em><span style=\"font-family: TimesNewRomanPS-ItalicMT;\"><strong>existants, l\u2019adjonction d\u2019\u00e9l\u00e9ments nouveaux, l\u2019am\u00e9nagement de locaux affect\u00e9s \u00e0 l\u2019usage\u00a0<\/strong><\/span><\/em><\/div>\n<div><em><span style=\"font-family: TimesNewRomanPS-ItalicMT;\"><strong>c ommun ou la cr\u00e9ation de tels locaux \u00bb .\u00a0<\/strong><\/span><\/em><\/div>\n<div><em><span style=\"font-family: TimesNewRomanPS-ItalicMT;\">\u00a0<\/span><\/em><\/div>\n<p><strong style=\"font-family: TimesNewRomanPS-BoldMT;\"><span style=\"color: #ff0000;\">3\u00b0 Autorisation donn\u00e9e aux copropri\u00e9taires d\u2019entreposer leurs v\u00e9los dans une cour<\/span>\u00a0<\/strong><span style=\"font-family: TimesNewRomanPS-BoldMT;\"><strong><span style=\"color: #ff0000;\">commune:<\/span>\u00a0<\/strong><\/span><\/p>\n<div><span style=\"font-family: TimesNewRomanPS-BoldMT;\"><strong>\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPS-BoldMT;\">\u00a0<\/span><span style=\"font-family: TimesNewRomanPS-BoldMT;\"><span><span style=\"text-decoration: underline;\"><span style=\"font-size: small;\">Dans le silence du r\u00e8glement de copropri\u00e9t\u00e9 :<\/span>\u00a0\u00a0<\/span><\/span><\/span><\/div>\n<div><strong>\u00a0<\/strong><\/div>\n<div><span style=\"font-family: TimesNewRomanPS-BoldMT;\">\u00a0<\/span><span><span style=\"font-family: TimesNewRomanPSMT;\"><strong>Sous r\u00e9serve que la destination de l\u2019immeuble ne s\u2019y oppose pas, l\u2019assembl\u00e9e des\u00a0<\/strong><\/span><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>copropri\u00e9taires peut modifier le r\u00e8glement de copropri\u00e9t\u00e9 et y ins\u00e9rer une clause pr\u00e9voyant la\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>possibilit\u00e9 pour les propri\u00e9taires de deux-roues de les garer dans la cour. Pour \u00eatre valables, les clauses doivent se justifier par l\u2019int\u00e9r\u00eat de la\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>collectivit\u00e9 et respecter la destination de l\u2019immeuble.\u00a0<\/strong><\/span><\/div>\n<div><strong><span style=\"font-family: TimesNewRomanPSMT;\">\u00a0<\/span>\u00a0<\/strong><\/div>\n<div style=\"text-align: left;\"><span style=\"font-family: TimesNewRomanPSMT;\"><strong>Il est donc courant que des clauses concernent le stationnement des v\u00e9hicules. d \u2019autre part, les deux tiers des voix des copropri\u00e9taires pr\u00e9sents et repr\u00e9sent\u00e9s (et non\u00a0<\/strong><\/span><\/div>\n<div><span style=\"font-family: TimesNewRomanPSMT;\"><strong>plus de tous les copropri\u00e9taires), majorit\u00e9 d\u00e9j\u00e0 recueillie en premi\u00e8re assembl\u00e9e ;
